L'Aresti payant ! 24/11/2005
Une nouvelle "fracassante" en provenance de la FAI (Fédération Aéronautique Internationale) vient de nous être communiquée par Guy Revel : la Famille de Jose Luis Aresti (récemment décédé) a décidé de distributer par ses propres moyens le fameux code de notation des figures de voltige utilisé en aviation grandeur et en modélisme et de lui appliquer les lois sur les "copyrights".
Cela signifie à priori que l'on ne pourra plus utiliser ce type de notation sans devoir payer des royalties dans le cadre d'une utilisation commerciale... et cela pourrait bien concerner les reproductions de programmes de voltige présentés dans la presse ! Inutile de vous dire que l'on considère cette nouvelle comme un véritable coup dur ! ;o) Voici le texte d'un représentant officiel de la FAI en version originale : "After a long drawn-out dispute, FAI recently signed an agreement with the heirs of José Luis Aresti, which in essence gives them back control over the Aresti aerobatic catalogue. We have now therefore now had to take the Aresti catalogue off our (CIVA) website. In future we will refer people who wish to purchase a copy of the catalogue to the Aresti family company. If you click on their site http://www.arestisystem.com and then on "Aerobatics" , you will see that they clearly have an intention of offering something specifically for the F3A community. I do not yet know what this might be. In the meantime, we have checked the contents of your Sporting Code, Annex 5.A, where we find a description using Aresti symbols of the schedules to be flown (the 'programs'), together with an explanation of the Aresti symbols themselves. Our agreement has a clause that states: "Aresti System S.L. authorizes the FAI to continue to use the Aresti Aerocryptographic System, for noncommercial use and free of charge, so that it continues to be the base for its aerobatic and artistic flight disciplines, in its sports commissions, and continues to form part of its sporting codes and regulations, provided it does not explicitly fully or partially reproduce the content of the Aresti Aerocryptographic System, thus damaging its marketing by Aresti System S.L. Noncommercial use authorized by this Agreement is defined as the use by the FAI or the organizers and participants in FAI-dependent aerobatic and artistic flight events of the reproduction of the figures necessary for the design and organization of the aerobatic and artistic flight competitions and events, at all stages of organization and dissemination." Subject to legal opinion, I believe that these clauses authorise CIAM to continue including extracts such as those in Annex 5A in your publications. Please however be aware that from now on, everyone in the F3A world should be aware of the need for care in reproducing Aresti symbols without authorization from the copyright owners. As far as I can see, no other aeromodelling discipline uses Aresti figures - F3D seems to use another system. But please pass this message on if anybody else is concerned." Nouveau commentaire :
